IMPORTANT: These Terms contain an arbitration clause and class action waiver that affect your legal rights. Please read Section 15 carefully.

3. User Accounts

You may create an account to access additional features. You are responsible for:

  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up to date

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may close your account at any time by contacting us.

4. Booking Services

4.1 Booking Process

When you make a booking through our Services:

  • You are entering into a contract directly with the hotel
  • We act as an intermediary to facilitate the booking
  • All bookings are subject to availability and hotel confirmation
  • Prices are subject to change until booking is confirmed
  • You must provide accurate guest and payment information

4.2 Payment

  • Payment is required at time of booking via credit or debit card
  • All payments are processed securely through PCI-compliant third-party payment processors
  • Prices shown include all taxes and fees unless otherwise stated
  • You authorize us to charge the payment method provided
  • Currency conversion may apply for international bookings

4.3 Confirmation

Upon successful booking, you will receive a confirmation email with your reservation details and hotel voucher. This confirmation serves as proof of your booking. You must present this confirmation (digital or printed) along with valid ID at hotel check-in.

5. Cancellations and Refunds

5.1 Cancellation Policies

Cancellation policies are set by each hotel and vary by property and rate type:

  • Refundable Rates: May be cancelled within the specified timeframe (typically 24-48 hours before check-in) for a full refund
  • Non-Refundable Rates: Cannot be cancelled or modified; no refunds will be issued
  • Partial Refunds: Some hotels may charge a cancellation fee

The specific cancellation policy for your booking is shown during the booking process and in your confirmation email.

5.2 How to Cancel

To cancel a booking:

  • Log in to your account and navigate to "My Trips"
  • Select the booking you wish to cancel
  • Click "Cancel Reservation" and follow the prompts
  • You will receive a cancellation confirmation email

5.3 Refund Processing

Approved refunds will be credited to the original payment method within 5-10 business days. Processing time may vary depending on your financial institution.

5.4 No-Shows

If you fail to check in on the scheduled date without prior cancellation, the hotel may charge the full booking amount. No refunds will be issued for no-shows.

6. Pricing and Fees

  • Displayed Prices: All prices shown are in USD (or your selected currency) and include applicable taxes unless otherwise stated
  • Service Fees: We do not charge booking fees; the price shown is the final price
  • Hotel Charges: Hotels may charge additional fees for services (parking, resort fees, early check-in, etc.) not included in the booking price
  • Price Errors: We reserve the right to cancel bookings made at incorrectly displayed prices
  • Price Match: If you find a lower price for the same hotel, dates, and room type within 24 hours of booking, we will match it and refund the difference

7. Hotel Responsibilities

We are not responsible for the quality of hotel services, amenities, or accommodations. Hotels are solely responsible for:

  • Room cleanliness, maintenance, and safety
  • Accuracy of property descriptions and amenities
  • Staff conduct and customer service
  • Food and beverage quality
  • Compliance with local laws and regulations

Any complaints about hotel services should be directed to the hotel management. We will assist in relaying your concerns but cannot guarantee resolution.

8. Prohibited Conduct

You agree not to:

  • Use our Services for any unlawful purpose
  • Provide false or misleading information
  • Impersonate another person or entity
  • Attempt to circumvent security measures
  • Use automated tools (bots, scrapers) to access our Services
  • Interfere with the proper functioning of our Services
  • Upload malicious code, viruses, or harmful content
  • Collect user data without authorization
  • Make fraudulent bookings or chargebacks
  • Resell or transfer bookings without our consent

Violation of these prohibitions may result in immediate account termination and legal action.

9. Intellectual Property

All content on our Services, including text, graphics, logos, images, software, and trademarks, is owned by Hotel Reservation Portal LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, distribute, or reproduce our content without permission
  • Use our trademarks or branding without authorization
  • Create derivative works based on our Services
  • Remove or alter copyright notices

10. Third-Party Links and Services

Our Services may contain links to third-party websites, services, or advertisements. We do not endorse or assume responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and the third party. We encourage you to review their terms and privacy policies.

11. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that our Services will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of hotel information
  • Warranties that defects will be corrected

Some jurisdictions do not allow disclaimers of implied warranties, so the above may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOTEL RESERVATION PORTAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage resulting from your use of our Services
  • Hotel services, accommodations, or conduct
  • Errors or omissions in hotel information or pricing
  • Unauthorized access to your account or data
  • Third-party content, products, or services

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE BOOKING GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on liability, so the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hotel Reservation Portal LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your conduct in connection with our Services
  • Fraudulent or illegal activity

14. Modification of Services and Terms

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of our Services at any time
  • Update these Terms at our discretion
  • Change pricing or features without prior notice

Material changes to these Terms will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after changes constitutes acceptance of the updated Terms.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing a claim, you agree to contact us at support@hotel-reservation-portal.com to attempt informal resolution. We will work in good faith to resolve your dispute within 30 days.

15.2 Binding Arbitration

If informal resolution fails, you and Hotel Reservation Portal LLC agree to resolve disputes through binding arbitration instead of court, except for:

  • Small claims court disputes (under $10,000)
  • Intellectual property claims
  • Requests for injunctive relief

15.3 Class Action Waiver

YOU AND HOTEL RESERVATION PORTAL LLC AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

15.4 Arbitration Rules

Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision is final and binding. You may opt out of arbitration by sending written notice within 30 days of first using our Services.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hotel Reservation Portal LLC regarding your use of our Services, superseding any prior agreements or understandings.
